On December 12, 2020, Mr. WU Yuzhang, a researcher from the Institute of Law, Chinese Academy of Social Science, was invited to give a special lecture on the theme of The Concept and Attributes of Legal Power at Room C301 of Lijiao Building, Beijing Normal University at Zhuhai.
This lecture was presided over by Professor LIU Peifeng, Director of the Teaching and Research Center of Constitutional and Administrative Law, Law School, Beijing Normal University, and attended by Professor CHAI Rong and Professor XIA Limin from the Law School. Accompanied by enthusiastic applause, Mr. WU Yuzhang made an introduction to the reality that the concept of legal power has not been specifically explained by law language in jurisprudence. Starting with other knowledge pedigrees besides the science of law, he introduced the understanding of legal power by different scholars in western sociology, political science and history, and introduced the views and opinions of Plato, Aristotle, Weber, Parsons and Foucault on the concept of legal power vertically. Although the explanations of the concept of legal power in these peripheral disciplines of jurisprudence are pervasive, they also played a very important role in the ideological origin of the concept interpretation.
Then, from the perspective of jurisprudence itself, Mr. WU Yuzhang went deep into the discipline of jurisprudence, and systematically expounded the explanations and theories of many modern western jurists on legal power, such as Bentham, Austin, Kelsen and Hart. By commenting on these viewpoints, Mr. WU patiently explored and revealed the fundamental attributes of legal power for everyone. Finally, starting from his own research direction, Mr. WU systematically expounded the concept and attributes of legal power by discussing the characteristics of legal power in Charity Law, the difference between legal power and legal right, and the connection between legal power and legal responsibility.
Professor LIU Peifeng, Professor XIA Limin and Professor CHAI Rong also expressed their views on the concept of legal power from their respective research fields, and made detailed analysis and discussion on how the concept of legal power fell into the reality of legislation and judicature from various angles, thus slowly spreading a theoretical picture with abundant information for the students, perfecting their knowledge structure and broadening their knowledge.
This lecture attracted the active participation of many teachers and students, and they have gained the understanding and inspiration of social science knowledge and legal theory. What they have learned will better encourage students to establish the unique legal thinking mode of legal person and make their own contribution to promoting the rule of law in China.
